1. Agreement to these terms
These Terms of Use (“Terms”) govern your use of Lunch Box website and online services. By using the site or submitting an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.
2. Eligibility and alcohol
You must be legally capable of entering a contract to place an order. You must be at least 21 years old to purchase or pick up alcoholic beverages. We may require valid government-issued photo identification and may refuse alcohol service or pickup when required by law, identification is missing, the purchaser appears intoxicated, or safety is at risk. An order confirmation does not override alcohol laws or responsible-service obligations.
3. Menu, availability, and pricing
Menu descriptions, ingredients, images, prices, event details, and availability may change. Images are illustrative. We try to provide accurate information but may correct errors, update pricing, substitute unavailable items with your approval, or cancel an unavailable item. Taxes, fees, and the final total are shown before payment where applicable.
4. Allergies and special requests
Tell us about allergies before ordering and speak directly with staff when you arrive. Notes submitted online are requests and are not guaranteed. Our facility handles common allergens, and cross-contact may occur. If you have a severe allergy, contact us before placing an order.
5. Orders and acceptance
Submitting an order is an offer to purchase. We may accept, reject, limit, or cancel an order for availability, pricing errors, suspected fraud, legal compliance, safety, or operational reasons. You are responsible for accurate contact, pickup, and order information. Estimated preparation or pickup times are not guarantees.
6. Payment
Online payment is not currently enabled. When Lunch Box activates online ordering, payments will be processed through its own Square account and Square’s terms and privacy practices will apply. You authorize the displayed charge when completing an enabled checkout. Contact us promptly if you believe a charge is incorrect or duplicated.
7. Pickup and order status
Arrive within the communicated pickup window and provide the order name or number. Alcohol orders require age verification. The public status board may display a customer’s first name and order number. Do not rely on the status board for emergencies or guaranteed timing.
8. Cancellations and refunds
Cancellations and refunds are governed by our Refund Policy. Event-space bookings or inquiries made through AppiSpot may be governed by separate booking terms shown by that service or in your event agreement.
9. Acceptable use
You may not misuse the website, attempt unauthorized admin access, interfere with service, bypass security, submit fraudulent orders, scrape content at unreasonable volume, introduce malicious code, impersonate another person, or use the site in violation of law.
10. Intellectual property
The website design, text, branding, logos, photographs, and other content are owned by or licensed to Lunch Box and are protected by applicable law. You may use the site for personal, noncommercial purposes. No other license is granted.
11. Third-party services
Square, Convex, AppiSpot, map providers, and social platforms are independent services. Their terms may apply when you use them. We are not responsible for third-party outages, content, or practices beyond our legal obligations.
12. Disclaimers
To the extent permitted by law, the website is provided “as is” and “as available.” We do not promise uninterrupted operation, error-free content, or that every item or event will remain available. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
13. Limitation of liability
To the extent permitted by law, Lunch Box will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use. Our aggregate liability relating to an online order will not exceed the amount you paid for that order, except where a different remedy is required by law. These limits do not apply where prohibited.
14. Governing law and disputes
Connecticut law governs these Terms, without regard to conflict-of-law principles. Subject to applicable law, disputes will be brought in courts serving the jurisdiction where Lunch Box operates. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally.
15. Changes and severability
We may update these Terms by posting a revised version and date. Continued use after a change means you accept the updated Terms. If a provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver.
